These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "User", or "Subscriber") and Edgethink ("dtime", "we", "our", or "us") governing your access to and use of dtime.co, the dtime desktop application, and any related products or services (collectively, the "Platform" or "Services").

By accessing or using the Platform, creating an account, downloading the application, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not use the Platform.

01Description of services

dtime is a productivity and activity analytics platform designed to help users better understand digital behavior, attention patterns, application usage, and time allocation.

The Services may include:

  • Activity tracking
  • Productivity analytics
  • AI-generated insights and summaries
  • Categorization systems
  • Reports and visualizations
  • Experimental and beta features

We may modify, improve, suspend, or discontinue portions of the Services at any time.

02Eligibility

You may use the Services only if you are legally permitted to enter into a binding agreement under applicable law in your jurisdiction.

By using the Services, you represent and warrant that:

  • You have the legal authority to accept these Terms
  • The information you provide is accurate
  • You will comply with applicable laws and regulations

03Your account

You may create an account using email/password authentication or supported third-party login providers such as Google.

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity occurring under your account
  • Promptly notifying us of unauthorized access or security incidents

We reserve the right to suspend or terminate accounts that violate these Terms or create risk for the Platform or other users.

04Data and activity tracking

By using the Services, you acknowledge and consent that dtime may collect and process activity-related information necessary to provide the Platform, including:

  • Application names
  • Window titles
  • Website domains
  • Usage duration and activity timestamps
  • Device and operating system information
  • Productivity categorizations and metadata

This information may be analyzed by automated systems and AI models to generate summaries, recommendations, analytics, and productivity insights.

You are responsible for ensuring your use of the Services complies with applicable workplace, organizational, and local privacy laws.

05Subscriber data and generated content

You retain ownership of your personal data, submitted information, and generated outputs to the extent permitted by law.

By using the Services, you grant dtime a non-exclusive, worldwide license to host, process, analyze, reproduce, and create derivative works from your data solely for purposes including:

  • Operating and maintaining the Services
  • Improving Platform functionality
  • Developing algorithms and AI systems
  • Research and analytics
  • Generating aggregated, anonymized, or de-identified insights

We do not sell your personal data to advertisers or data brokers.

06Service data

dtime may create aggregated, anonymized, statistical, or derivative data based on usage patterns, metadata, and Platform interactions ("Service Data").

Service Data does not identify individual users and may be used for:

  • Analytics
  • Benchmarking
  • Research
  • Product improvement
  • AI and machine learning development
  • Internal business operations

dtime retains all rights, title, and interest in Service Data.

07Acceptable use

You agree not to:

  • Reverse engineer or attempt to extract source code from the Platform
  • Interfere with Platform security or infrastructure
  • Use the Services for unlawful, harmful, or abusive purposes
  • Circumvent technical limitations or access controls
  • Use the Platform to violate the privacy rights of others

We reserve the right to investigate and take action against misuse of the Services.

08Beta features

Certain features may be labeled as beta, experimental, preview, or early access features.

These features may contain bugs, inaccuracies, interruptions, or incomplete functionality and may be modified or removed at any time without notice.

09Third-party services

The Platform may integrate with or rely upon third-party providers, including infrastructure, analytics, authentication, and AI services. These may include:

  • Firebase
  • Supabase
  • PostHog
  • Vercel
  • OpenAI
  • Anthropic
  • Amplitude
  • Sentry
  • Google Analytics

Your use of third-party services may also be subject to their respective terms and privacy policies.

10Future team and workspace features

dtime may introduce team, organization, or workspace functionality in the future.

If such features are introduced, workspace administrators may have access to organization-level reports, aggregated analytics, or approved workspace data based on role permissions.

Additional terms may apply to organizational features when released.

11Intellectual property

The Platform, including its software, branding, design, interfaces, algorithms, and related intellectual property, is owned by Edgethink or its licensors and is protected by applicable intellectual property laws.

Except as expressly permitted under these Terms, you may not copy, modify, distribute, sell, sublicense, or exploit any portion of the Services.

12Feedback

If you provide suggestions, feedback, ideas, or recommendations regarding the Platform, you grant dtime a non-exclusive, perpetual, irrevocable, worldwide, royalty-free license to use and incorporate such feedback without restriction or compensation.

13Availability and changes

We do not guarantee uninterrupted or error-free operation of the Services.

We may change, suspend, restrict, or discontinue any part of the Platform at any time, with or without notice.

14Termination

You may stop using the Services at any time.

We reserve the right to suspend or terminate access to the Services if:

  • You violate these Terms
  • Your use creates legal or security risk
  • Required by law
  • Necessary to protect the Platform or other users

Upon termination, provisions that by their nature should survive termination will remain in effect.

15Disclaimer of warranties

To the maximum extent permitted by law, the Platform and Services are provided "as is" and "as available."

dtime disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not guarantee that the Services will be uninterrupted, secure, error-free, or free of harmful components.

16Limitation of liability

To the maximum extent permitted by law, dtime and Edgethink shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, profits, goodwill, or business interruption.

Our total liability arising out of or relating to the Services shall not exceed the amount paid by you to dtime, if any, during the three (3) months preceding the claim.

17Indemnification

You agree to indemnify and hold harmless Edgethink, dtime, and their affiliates, employees, contractors, and representatives from any claims, damages, liabilities, and expenses arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of applicable laws or third-party rights

18Privacy

Your use of the Services is also governed by our Privacy Policy.

19Governing law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

20Changes to these terms

We may update these Terms from time to time.

If material changes are made, we may notify users through the Platform, by email, or by updating the Effective Date.

Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
